This briefing sets out NHS Providers’ submission in response to a call for evidence by the Department of Health and Social Care (DHSC) on the application of the statutory duty of candour across the health and care system.

DHSC issued the call as part of its review into the operation, including compliance and enforcement, of the statutory duty of candour for health and social care providers in England. The review was announced on 6 December 2023 and the terms of reference for the review were published on the same date. This evidence was submitted to the DHSC in May 2024.

Our response focused on insights from provider trusts and drew on our knowledge of good practice.
